User Agreement
The administration of the "Epoch of the Fighting Club" project, hereinafter referred to as the "Administration," offers to enter into this Agreement under the conditions set forth below with a natural person, hereinafter referred to as the "User," who has expressed consent to the terms of this Agreement. By accepting the terms of this Agreement, the User expresses agreement with all its provisions. The User's consent to the provisions of this Agreement is a mandatory condition for the commencement of using the "Epoch of the Fighting Club" project (hereinafter referred to as the "Game"). The text of this Agreement may be amended by the Administration. The User will be obliged to confirm the new Agreement. By accepting the terms of this Agreement, the User confirms that they are legally capable and competent to enter into this Agreement. The User guarantees that the equipment and communication means used by them, including the services of the communication operator, are sufficient and functional for participating in the Game. The rights of the developers and owners of the Game belong to the Administration and are protected by legislation on intellectual property and copyright.
GENERAL PROVISIONS
1.1. "Epoch of the Fighting Club" is a multiplayer game hosted on the Internet at the addresses: https://icombats.ru (hereinafter referred to as the Game Website).
1.2. A "User" of the Game is any person who has gained access to the game in accordance with this Agreement, using the materials posted on the Game Website for private, personal purposes only.
1.3. The Administration undertakes to provide the User with access to the Game free of charge. The User pays for their own Internet access.
1.4. "Materials" or "components" of the game include any text, photographic images, graphics, as well as any data in visual, audio, audiovisual, or other forms available on the Game Website.
1.5. The description of the Game and its rules are outlined in the "Game Rules" section of the website and on the game forum, constituting an integral part of this Agreement and being mandatory for the User to follow.
1.6. If, according to the laws of your country, you are prohibited from receiving online gaming services, or if there are other legislative restrictions, including age restrictions for access to such services, you are not permitted to use the Game or certain services within the Game. You are obliged to immediately cease using the Game or such services.
SUBJECT OF THE AGREEMENT
2.1. In accordance with the terms of this Agreement, the Administration provides the User with the right to use the Game in accordance with the game rules around the clock, except during maintenance and other circumstances preventing the User from accessing the Game, not caused by the Administration.
2.2. The User agrees to comply with the terms of this Agreement.
2.3. From the moment the User accepts the terms, all provisions of the Agreement apply to them.
2.4. In case of violation of this Agreement by the User, the Administration reserves the right to deny further access to the Game.
2.5. The information posted on the Game Website is official information from the Administration, mandatory for every User who has entered into this Agreement.
2.6. All materials and works submitted by the User for contests and/or for which game items or currency are received become the property of the Administration. From the moment of submission, the User transfers all rights to use these materials and works to the Administration.
2.7. The Player is hereby notified that the Game may include various sound and/or video effects that, under certain circumstances, may trigger exacerbations of conditions for individuals prone to epileptic or other nervous disorders, and the Player guarantees that they do not suffer from such disorders, or agrees not to use the Game.
2.8. The Player is hereby notified that regular prolonged (continuous) use of a personal computer may lead to various physical complications, including impaired vision, scoliosis, various forms of neuroses, and other negative impacts on the body. The Player guarantees that they will use the Game only for a reasonable amount of time, with breaks for rest or other activities to maintain physical health, if recommended or prescribed.
RIGHTS AND OBLIGATIONS OF THE ADMINISTRATION
3.1. The Administration undertakes not to deliberately disclose User information provided during registration to third parties, except in cases provided for by law and international norms, and also not to change the User's name and password without their consent. The Administration does not send users unsolicited electronic or other messages; if a user receives such a message from the Administration, they should immediately inform the Administration.
3.2. The Administration is not responsible for temporary technical failures and interruptions in the Game, for temporary failures and interruptions in communication lines, or other similar failures, as well as for malfunctions of the computer from which the User accesses the Internet.
3.3. The Administration is not responsible for losses incurred as a result of the User's use or non-use of information about the Game.
3.4. The Administration undertakes to ensure the functionality of the software used to process information regarding monetary transactions.
3.5. The Administration has the right to unilaterally reduce the User's game account upon discovering the User's dishonest actions leading to an unjustified increase in their game account.
3.6. The Administration is not liable to the User for the actions of other users.
3.7. The Administration has the right to delete or modify any information posted by the User on the Game Website without prior approval from the Administration or not provided for by this Agreement, as well as other agreements with the Administration.
3.8. The Administration has the right to delete or block the User's account, especially if there is a violation of the Game Rules and/or this Agreement. Legal claims, due to the free nature of the Game, are excluded.
3.9. The use of the Game's services is solely at the User's discretion and on an "as-is" basis, meaning the Administration is not liable to the User under any circumstances for any direct and/or indirect damages that may arise from receiving or being unable to receive the game's service.
3.10. The Administration has the right to send Users electronic messages of an informational or technical nature related to the Game. Also, with the additional consent of the User.
3.11. All interactions within the framework of the Agreement are conducted in Russian.
USER RIGHTS
4.1. The User has the right to use the Game exclusively for non-commercial personal purposes in accordance with the game rules.
4.2. Upon registration, the User chooses a name and password that will identify the User among other players. For access, the User must provide the Administration with the following accurate information: email address, date, month, and year of birth.
4.3. The User has the right to change their password. The User is responsible for maintaining the confidentiality of their password and other necessary data and bears all risks (losses) associated with this.
4.4. The User may submit complaints and suggestions related to the use of the Game in writing or via email to the addresses specified on the Game Website.
USER OBLIGATIONS
5.1. The User is not allowed to exploit software errors and is obliged to immediately report them to the Administration, interfere with the program code, gain unauthorized access to the computer system, or access the database of game users or Game materials without proper authorization from the Administration. Upon detecting such attempts, the Administration reserves the right to submit materials to law enforcement for criminal proceedings under Articles 272, 273, or 274 of Chapter 28 of the Criminal Code of the Russian Federation or other similar laws of the countries where the violator resides.
5.4. The User is not allowed to disseminate information aimed at violating the Game rules or to share links to websites containing such information.
5.5. The User agrees to treat other users and the Administration of the Game with respect and courtesy; not to distribute in any way materials that promote or express dislike or hatred towards any religion, culture, race, nation, people, language, politics, ideology, or social movement; not to advertise pornographic sites, drugs, and resources containing such information, as well as to refrain from any other similar actions prohibited by the laws of the Russian Federation and/or the laws of the countries where the User resides.
5.6. The User is not allowed to restrict access to the Game for other Users or impede other Users in using the Game.
5.7. The User is prohibited from copying, reproducing, distributing, and translating any component of the Game into other languages without the Administration's written permission. The User acknowledges and agrees that any material and all necessary programs related to the Game are protected by copyright laws of the Russian Federation and other international laws, and the content provided to the User during the use of the Game is protected by copyrights, trademarks, patents, and other relevant laws. The User is not allowed to modify, sell, distribute this information, Game material, and programs, in whole or in part. The Administration grants the User a personal, non-exclusive, and non-transferable right to use the content, Game material, and software provided in the Game in accordance with the game rules, provided that neither the User nor any other persons with the User's assistance will copy or modify the content and software; create programs derived from the software; penetrate the software to obtain program codes; sell, assign, lease, or transfer any rights regarding the Game material and software to third parties in any other form, as well as modify the service, including for unauthorized access.
5.8. The User agrees that in the event of their breach of obligations, the Administration has the right to impose sanctions at any time, expressed in prohibiting the User from using the Game, or using other methods of influence: warning, temporary blocking of access to the Game, claims for damages, and other actions.
SPECIAL CONDITIONS
6.1. The Administration does not guarantee that the Game software is error-free or will function without interruption.
6.2. The Administration is not responsible for losses or other harm incurred by the User due to the actions of third parties, including former employees of the Administration.
6.3. The Administration reserves the right to delete any information or materials from its servers that, in the Administration's opinion, are unacceptable, undesirable, or violate this Agreement.
6.4. The Administration has the right to unilaterally limit, expand, or change the quality of services at any time without prior notice to the User.
6.5. The Administration has the right to unilaterally change the terms of this Agreement at any time. Changes take effect from the moment they are published on the Game Website or from another moment established by the Administration. In case of changes, the Administration will require the User to confirm their agreement with the License Agreement again.
6.6. If the User pays for the provision of certain services and/or game coins or items, this does not lead to any claims regarding rights arising after the payment is made. Such Users are subject to the same rules as free Users, and all rights remain with the Game owner. Claims for refunds are not accepted. Any violation of the General Provisions, game rules, or applicable laws may lead to termination of access to the Game.
6.7. This Agreement is governed by the laws of the Russian Federation. Disputes arising from this Agreement shall be resolved through negotiations. If the dispute is not resolved amicably, it will be submitted to the appropriate judicial authority determined in accordance with the laws of the Russian Federation, unless otherwise provided by international law.
6.8. The invalidity of one or more provisions of the agreement recognized in accordance with the established procedure by a court decision does not entail the invalidity of the agreement as a whole for the parties. In case one or more provisions of the agreement are recognized as invalid in accordance with the established procedure, the Parties undertake to fulfill their obligations under the agreement as closely as possible to what the Parties intended when entering into and/or agreeing to amend the agreement.
6.9. In the event of changes in the legislation governing the relations established by the agreement between the Parties, the Parties undertake to fulfill their obligations under the agreement as closely as possible to what the Parties intended when entering into and/or agreeing to amend the agreement, including, but not limited to, the volume of transferred rights, the procedure and methods of obtaining additional Game services, the conditions for supporting the Game, or terminating the agreement.
ENTRY INTO FORCE AND TERM OF THE AGREEMENT
7.1. This Agreement comes into force upon the User accepting its terms on the Game Website by selecting and clicking the "I agree" option (or another similar option). The User agrees that their selection of the above option means that they have fully familiarized themselves with the terms of this Agreement and accept them without any exceptions.
7.2. The Agreement is concluded for an indefinite period.
7.3. The Administration has the right to unilaterally terminate this Agreement and cease providing services for using the Game without compensation for damages, with prior notice to the User of the termination of the Agreement at least one month in advance. Notification may be made by publishing this information on the Game Website.
7.4. All changes, additions, appendices to this Agreement, or other information are an integral part of it and are mandatory for execution from the moment of publication on the Game Website, unless otherwise established by the Administration.
